Overview: EPA’s Multi-Sector General Permit (MSGP) relies on the submission of an electronic document called an Notice of Intent (NOI) to gain coverage under its permit. An NOI for a general permit is notice to the NPDES permitting authority of the operator’s intent to be covered under the general permit. An NOI typically contains basic information about the site and the proposed discharge. By signing and submitting the NOI, the operator is certifying that the information submitted is true, accurate, and complete, that the operator meets the eligibility requirements, and that, when covered, the operator will comply with the permit conditions and effluent limitations. A fraudulent or erroneous NOI invalidates permit coverage. An incomplete NOI delays permit coverage until the NOI has been completed and the applicable waiting period has passed (i.e.,30 days for the EPA MSGP).

 

 

TO CREATE A NEW NOI

  1. Go to https://cdx.epa.gov  
  2. Type in your CDX User ID and Password
  3. Click on your associated Role located next to the NETEPAMSGP program service name to enter the MSGP application
    • Signatory (Formerly Certifiers/DARs/Permit Administrators:

Individual who will be signing/certifying submissions to EPA or managing facility user permissions.

  • Preparer: Individual who will be viewing and editing data
  1. Make sure your Application Profile Settings are correct, click Proceed to continue
  2. You will be redirected to the MSGP Homepage with a list of your facilities
    • If you are a first-time user, no facilities will be listed on your homepage
  3. To create a new NOI, click on the Search for a facility to request permissions or create an NOI search bar located on top of MSGP homepage
  4. Type in the facility’s name
  5. If there is no match for your facility, then you should receive a “No results were found” followed by a Create facility link located in the search bar results
  6. Click on Create facility to create new NOI
  7. Upon clicking on Create facility, you will be taken to an Eligibility Information application form to verify your eligibility under the MSGP
  8. The MSGP application is a smart form- new questions will appear as you answer each question
  9. Make sure to answer all required questions to complete form
  10. If eligible after answering all questions, you will receive a Master Permit Number
  11. To complete eligibility form, type in the legal name of the Operator and the legal name of your facility/activity as defined in Appendix A , which are:
    • Operator – any entity with a stormwater discharge associated with industrial activity that meets either of the following two criteria:
      • The entity has operational control over industrial activities, including the ability to make modifications to those activities; or
      • The entity has day-to-day operational control of activities at a facility necessary to ensure compliance with the permit (e.g., the entity is authorized
    • Facility or Activity – any NPDES “point source” (including land or appurtenances thereto) that is subject to regulation under the NPDES program. (40 CFR 122.2)
  12. After typing in Operator and facility names, click Next to continue
  13. After clicking Next, a pop-up warning message will appear stating: “After clicking Next, you will no longer be able to edit any of your permit information responses…”
  14. Make sure to review information one more time by clicking Return on pop-up message before finalizing permit information

IMPORTANT: If you must change any of the information on the permit after clicking Next, you will need to start over and submit a new NOI

  1. If all information is correct, click Next on pop-up message to complete Eligibility Information form
  2. A pop-up message will appear stating you have successfully created a draft Notice of Intent (NOI) with the option to:
    • Return to Landing page
    • Manage Permissions
    • Continue NOI
  3. Click on Continue NOI to complete NOI form
  4. To obtain authorization, you must submit a complete and accurate NOI form by completing the following required information (all boxes with an asterisk * must be filled in):

Note: Some section will be prefilled from question answered in permit eligibility information section

You will be asked to type in the following information:

  • Operator
    • Address
    • City
    • State
    • Zip
    • Point of Contact Information
  • Facility
    • Address
    • City
    • State
    • Zip
    • Location of facility user map (latitude/longitude)
    • Horizontal Reference Datum
    • Ownership Type (state gov’t, corporation, tribal…)
    • Estimated area of industrial activity at your facility exposed to stormwater
    • Sector-Specific Information (can add multiple sectors)
      • Primary Sector
      • Primary Subsector
      • Primary SIC Code
    • Inactive/ unstaffed
  • Discharge
    • Federal Effluent Limitation
    • Benchmark Monitoring
    • Discharge into a Municipal Separate Sewer System (MS4)
    • Add Outfall(s)
    • Add location using map
    • Add Receiving Waters using Lookup Receiving Water Information
  • SWPPP
    • Has SWPPP been prepared in advance?
    • If no, you must complete preparation of your SWPPP in advance of filing out form
    • SWPPP Contact Information
    • You must clearly identify those portions of the SWPPP that are being withheld from public access by selecting:
      • Option 1: Maintain a Current Copy of your SWPPP on an Internet page (Universal Resource Locator or URL).
      • Option 2: Provide the following information from your SWPPP- 4-part question
    • Endangered Species Protection
      • Using instructions from Appendix E of MSGP, you must select the Criterion you are eligible for coverage:
        • Criterion A - No listed species of critical habitat are in the action area
        • Criterion B - Another operator has certified listed species and critical habitat eligibility for the action area under the current MSGP
        • Criterion C - Discharges and discharge related activities are not likely to adversely effect listed species and critical habitat
        • Criterion D - A separate ESA section 7 consultation has been completed
        • Criterion E - An ESA section 10 permit has been issued
      • Provide a brief summary and attach copies of any communication with U.S. Fish and Wildlife Service or National Marine Fisheries Service
    • Historic Preservation
      • Is facility located on Indian country lands
      • Select historic properties preservation criterion using instruction using Appendix F
    • Certification
      • Select from:
        • Certify Form – to sign and submit form to EPA
        • Flag for certification – to lock information and flag for certification
        • No action at this time – no action
  1. Before selecting, make sure all information is correct. If there is a red box next to a section that means that section is incomplete
  2. If all boxes are blue, then the form in complete
  3. If you are a signatory authorized to sign and submit NOIs, select Certify Form to complete NOI submission
    • A pop-up message will appear
    • Click Accept to continue
    • After clicking Accept, you will have to electronically sign NOI by entering your
      • CDX password
      • A signature answer
      • Click Sign
    • After signing, a message will appear stating your form has been certified and you will be receiving an email from EPA with an attached zip file of your CORs
  • Click OK
  • You will be redirected to your homepage
  • Your Coverage Status should now be Under Review
  • After 30days, your facility will be covered under the MSGP

 

Preparer

  1. If you are a preparer, you will have the option to:
    • Flag for certification – to lock information and flag for certification
    • No action at this time – no action
  2. Click Flag for certification
  3. A pop-up message will appear stating your form has been flagged for certification. A notification email has been sent to the signatory associated with the facility
  4. Click OK to continue
